In the following text of the General Terms and Conditions, for the sake of clarity and understanding of the text, the term User will be used when a Purchase Agreement has been concluded between the User and Picture perfect. Also, for the same reason instead of the term Picture Perfect d.o.o. the term Picture Perfect will be used, while the term Picture Perfect will also be used as the name of an online store, website, etc.

The conclusion of sales contracts via the website https://picture-perfect.hr is regulated in accordance with legal provisions, especially taking into account the principles and provisions of directives and regulations of the European Union. Concluding a contract via the website https://picture-perfect.hr is concluding a distance contract.
These General Terms and Conditions also constitute a pre-contractual notice when the contract of sale is concluded by the consumer, and if the contract is concluded between the trader and the consumer within an organized system of sales or service without the simultaneous physical presence of the trader and the consumer in one place. uses only one or more means of remote communication for concluding the contract.

Contracting procedure

When filling out the form, the User is obliged to enter all the information required of him. The purchase can be made with the confirmation of the User that he understands the General Terms and Conditions and that he accepts them. Shopping is possible 24 hours a day, 7 days a week. Picture Perfect is not responsible for the cost of using computer equipment and telecommunications services required to access the service. The user will be notified by email of the receipt of the order.
In the event that Picture Perfect is unable to deliver any of the ordered products, the User will be contacted by e-mail by a Picture Perfect employee for the purpose of agreeing on details, delivery of a replacement product of the same price range or informing him of the impossibility of delivery of a replacement or ordered product.
The purchase of products in the name and on behalf of a minor or a person deprived of legal capacity (in whole or in part) may be requested only by their legal representatives.
The purchase is made by ordering available products that the User chooses based on the photo and basic description. Shopping is done in a few easy steps from anywhere in the world.
You can order the product as a guest. You will only be asked for the information that is relevant to the processing of the order. The gift refers to the selected product and cannot be exchanged for money, and is usable only once. The gift is valid for 3 months from the purchase if it is an individualized program. The publisher, Picture Perfect, is not responsible for the accuracy of the information that the PP gift user receives from third parties. After purchase, the programs are sent to the Customer's e-mail, while Picture Perfect sends a personalized message. By purchasing individualized programs, the same procedure is followed as in a normal purchase, ie the questionnaire arrives at the Customer's e-mail, which should be forwarded to the selected user.

This stage in the online shopping process is a place where you can review all the details entered about payment options, shipping email address, cart contents, total value, etc., before you finally approve them. If any of the data may not be entered correctly, you can use the "Back" option to return to the step where you entered it and change it. After you place an order, the seller will send an order confirmation to your email address with the same number confirming that your order has been received and is being processed.

It is possible to issue R1 invoices for all forms of payment. Payment is considered made at the time of receipt of the authorization by the card issuer.
The agreed purchase price includes VAT and is expressed in Croatian kuna. Prices are also expressed in euros, and the fixed conversion rate is determined by the EU Council regulation (1 EUR = 7.53450 HRK).
Delivery
Delivery is made electronically by sending to the e-mail address you specified on the page "Payment details".
Receipt of shipment
The shipment was received at the time of sending to your e-mail address as previously indicated.
Basic program service packages are delivered to your e-mail address automatically upon completion of authorization or other form of payment. After processing, the Picture Perfect team will send you an individualized program tailored only to you to your e-mail within 3-5 days.

The right to unilateral termination of the contract
The user can unilaterally terminate the contract within 14 days without giving a reason.
The period of 14 days begins to run from the day when the product is handed over to the User or a third party designated by the User, who is not a carrier.
If the User orders several pieces of products to be delivered separately with one order, or if the goods are delivered in several pieces or more shipments, the period of 14 days begins to run from the day when the User or a third party designated by the User, and which is not the carrier, possessed the last piece or last consignment of the product.
If regular delivery of goods is agreed for a certain period, the period of 14 days begins on the day when the first piece or the first shipment of the product is handed over to the User or a third party designated by the User, who is not a carrier.
If the User is not notified of the right to terminate the contract, the User's right to unilateral termination of the contract expires after 12 months from the expiration of 14 days.
If Picture Perfect has notified the User of the right to terminate the contract within 12 months, the right to unilateral termination of the contract expires after the expiration of 14 days from the time the User received the notification.
In order for the User to be entitled to unilateral termination of the contract, he must notify Picture Perfect in writing of his decision to unilaterally terminate the contract before the expiration of 14 days by an unequivocal statement sent by mail to the headquarters address or e-mail to: info @ picture-perfect .hr, in which he will state his name and surname, address, telephone number and e-mail address, and the User may, at his own choice, use the form for unilateral termination of the contract contained in Annex I to these General Terms and Conditions.

Picture Perfect must refund the payment using the same means of payment used by the User when paying, unless the User expressly agrees to another means of payment, and assuming that the User is not obliged to pay any additional costs for such refund.
The right to terminate the contract of sale is not allowed in the following cases when:
* When the User is a legal entity, the section of these General Terms and Conditions entitled "Right to unilateral termination of the contract" does not apply to him.
* For legal entities, the Law on Obligations and the Law on Electronic Commerce apply.
Notice of the manner of written consumer complaint
All complaints in accordance with Article 10 of the Consumer Protection Act, the User may send by e-mail to info@picture-perfect.hr or by mail to the registered office.
In order for the Picture Perfect consumer to respond to a written complaint that is not sent by e-mail, Users are asked to provide accurate information about their name and address to which the response will be sent.
Picture Perfect must legally provide a written response to the User's complaint no later than 15 days from the date of receipt of the complaint.
If the User is a legal entity, the rules on consumer protection prescribed by these General Terms and Conditions and the Consumer Protection Act do not apply to him.
In the event of a possible dispute, Picture Perfect and the User will try to resolve the dispute amicably, and if this is not possible, the court with real and territorial jurisdiction in the Republic of Croatia with the application of Croatian law.
Consumer disputes can be resolved through the ODR platform of the European Commission on a link.
When you order products on the website https://picture-perfect.hr as a legal entity, you are not considered a consumer, and you are not covered by the sections of these General Terms and Conditions entitled "Right to unilateral termination of the contract" and "Notice of written manner consumer complaints ". In that case, the relevant provisions of the Civil Obligations Act and the Electronic Commerce Act apply to you.
